A nightclub in Edinburgh at the centre of legal action between Luminar and the Mama Group is due to re-open tomorrow — a year after it first opened.

The HMV Picture House opened its doors last September after a £1m refurbishment but a legal wrangle led to it being unable to open late.

Luminar, which sold the building to Mama Group, had launched the legal action after claiming the firm had agreed to ensure it would not put on club nights that would compete with Luminar's nearby Lava & Ignite.

The legal action began late on the day of the Picture House's first opening in September 2008. About 1,000 people turned up for the dance night but the dancefloor was roped off to prevent legal action.

The legal action arose because Luminar claimed it had an agreement with Mama for it to not put on entertainment "in direct competition on a like-for-like basis with the discotheque business" of Lava & Ignite.

But Judge Lord Glennie ruled that Picture House's music was "studenty and trendy" while Luminar's Lava & Ignite was "cheesy" and "a place where people go to pull" — so there was no direct competition.
