Guinness Community Outlet of the Year competition Terms & Conditions

1. Open to all residents of Great Britain who are aged 18 or over and who are licensees or managers of an on-trade outlet in Great Britain, provided that this promotion shall not be open to any employees of the Promoter, their families or to anyone who is otherwise professionally involved with this promotion.

2. To enter, you must tell us 'Why you are the Great GUINNESS® Community Outlet of the Year', by answering two questions in no more than 250 words each: i) What makes you a Great GUINNESS® Outlet?; ii) What does your outlet do to support the community? Answers should be sent with the entry postcards provided before the closing date (set out in 4. below) to the following freepost address: FREEPOST RRZH-JLHB-AJYU, Great GUINNESS® 250 Outlet, Olympic House, The Birches, East Grinstead, RH19 1EH, together with your name, address of your outlet and your contact details (including the phone number of your outlet). Any supporting photos and other evidence should be included with your entry card and sent to the freepost address.

3. Alternatively, you may enter by emailing your answers to guinness250outlet@tph-uk.com with Guinness Community Outlet in the subject line and providing your name, the address of your outlet and your contact details (including phone number); or by going to www.thepublican.com/Guinness250, and completing the entry form and your contact details as indicated. Any photos and other supporting evidence can be attached to your email or online entry via the Publican website.

4. The promotion will open on the 27 April 2009 and close on the 14 August 2009. Entries received after the closing date will not be accepted. One entry per outlet is permitted.

5. Any photos and other supporting evidence submitted with your entry shall not be returned. In the event you submit photographs with your entry, you warrant that any and all individuals pictured in any photographs submitted have consented to the submission of their images to this promotion and you agree that all forms of intellectual property rights (including all copyright) that may exist in the photographs are assigned to the Promoter. The Promoter and its associated companies are therefore entitled to use all photos in any way they choose, including, but not limited to, in promotional materials for the GUINNESS® brand.

6. A judging panel comprising of a senior representative from the GUINNESS® brand team, the GUINNESS® Quality Director and an independent member of the Publican, will short-list a minimum of 25 entries, being the entrants who have demonstrated in their entries (in the reasonable opinion of the panel) that their outlets have done the most to support their local community and to drive their sales and support of GUINNESS®.

7. Each entrant short-listed shall be visited in their outlet by a GUINNESS® Quality Executive to undertake a GUINNESS® quality assessment in the week commencing 24 August 2009. A representative of the Promoter will contact each entrant to arrange a time for the assessment. The Quality Executive will assess the product, dispense system, hygiene, glassware and the 2-part pour in the entrant's outlet and interview the entrant to learn more about their outlet and the community support their outlet offers. In addition, a mystery shopper may visit the outlets of the short-listed entrants during the promotional period to assess how the outlet supports GUINNESS®.

8. The panel will select one 1st prize winner from the entrants short-listed, being the entrant who has demonstrated that their outlet has done the most to support their local community and to drive their sales and support of GUINNESS® on the basis of their answers to the questions in clause 2. above, the GUINNESS® assessment, interview and mystery shop. Five runners up will be selected from the remaining entrants short-listed, being the entrants who, after the 1st prize winner, have demonstrated that their outlets have done the most to support their local community and to drive their sales and support of GUINNESS® on the basis of their answers to the questions in clause 2. above, the GUINNESS® assessment, interview and mystery shop.

9. The 1st prize winner shall win £5,125 for outlet improvements, a staff (to include the entrant) bonus of £3,075 and £2,050 worth of funding for an 'Arthur's Day' promotional activity to be hosted in the winner's outlet on 24 September 2009.

10. Five runners up shall each win £1,250 for outlet improvements, a staff (to include the entrant) bonus of £750 and £500 worth of funding for an "Arthur's Day" promotional activity to be hosted in each runner up's outlet on 24 September 2009.

11. The winners will be notified by phone on 2 September 2009. If the Promoter is unable to contact a winner after making reasonable attempts to do so, that winner shall forfeit their prize and the Promoter may offer the prize to another entrant.

12. Each winner shall receive a cheque made payable to them for the amount of their prize. Cheques will be posted by the Promoter within one week of making contact with the winners. Prizes are non-transferable.

13. The winners will be required to take part in publicity, including but not limited to, a feature in a case study for the Publican.

14. The Promoter does not take any responsibility for lost, illegible, incomplete or non-compliant entries in any way.

15. The details of the winners and those short listed shall be available by sending a stamped address envelope to GUINNESS® 250 Community Outlet, Lakeside Drive, Park Royal, NW10 7HQ, after the 25 September 2009. No other correspondence will be entered into concerning the result and the Promoter's decision is final.

16. The Promoter reserves the right to withdraw or amend this promotion in the event of any unforeseen circumstances outside their reasonable control.

17. The Promoter reserves the right to terminate or temporarily suspend this promotion in the event of technical or other difficulties that might compromise its integrity.

18. The Promoter and their agents accept no responsibility for difficulties experienced in submitting an entry to this promotion.

19. This promotion and these terms are governed by English law and subject to the exclusive jurisdiction of the English Courts.

20. Entrants are deemed to have accepted these terms and conditions by participating in this promotion.
